Georgia No License on Person Charges
Under O.C.G.A. § 40-5-29, drivers in Georgia must carry their licenses in their immediate possession while operating a motor vehicle. The law also specifies that licensees are obligated to present their licenses upon demand of a law enforcement officer. Failure to do so creates a presumption that the person is driving without a valid license, a violation of O.C.G.A. § 40-5-20 and a much more serious charge. This presumption may be overcome by the driver appearing in court and presenting a license that was valid at the time of the stop. If the driver presents such evidence, he or she will only be convicted of No License on Person and fined no more than $10.
Temporary Paper Licenses
In Georgia, when a person goes to the Department of Driver Services to obtain a license, he or she may not receive a plastic driver’s license that day, but instead may receive a paper or cardboard copy of a license or even just a receipt reflecting issuance, renewal, replacement, or reinstatement of his/her driver’s license. Such a document may be deemed to satisfy this law if it confirmed to be valid by DDS or through the Georgia Crime Information Center, or GCIC. However, such a document only shows that a person has a valid license and does not prove identification for any other purpose (for example, to purchase alcohol).
